Who collects your personal data

The Results Based Agri-environment Payment Scheme (RBAPS) is a pilot scheme. Natural England and the Department for Environment, Food and Rural Affairs (Defra) collect your data for:

• scheme administration purposes (‘scheme data’)
• market research purposes (‘research data’)

Research data

Natural England and Defra collect voluntary data from RBAPS agreement holders for research to understand their experience and attitude towards the pilot. The joint data controllers are Natural England and Defra.

What personal data’s collected and how it’s used

For scheme data, Natural England collects and stores your:

• name and contact details
• bank account details

Natural England uses the data to administer and analyse applications, agreements and claims under the RBAPS pilot.

For research data, Natural England and Defra collect and store your:

• name and contact details
• experiences of and attitudes to the RBAPS pilot

This data:

• provides feedback to Natural England about your agreement
• allows Natural England to understand the strengths and weaknesses of results-based payment approaches

Natural England collects some of this data as part of its administration of the pilot scheme and shares it with Defra. Natural England and Defra collect the rest of the data as part of the research.

The legal basis for processing your personal data

The legal basis for processing your scheme data is the performance of:

• a contract between you and Natural England - the RBAPS agreement
• a task carried out in the public interest - to manage the grant agreement that forms part of the RBAPS pilot

The legal basis for Natural England and Defra to process your research data is your consent.

Consent to process your data

The processing of your scheme data is not based on consent. You cannot withdraw it.

The processing of your research data is based on your consent. You can withdraw this consent until Natural England and Defra make your data anonymous and combine it with other research data. The time this happens is specified with each research activity. You can withdraw your consent until this point by contacting the data controller at Natural England or Defra.

Who Natural England and Defra share your personal data with

Natural England will share your personal scheme data with:

• Defra - to share the results and findings of the pilot
• the Rural Payments Agency - for claims checks
• the Yorkshire Dales National Park Authority - to help Natural England assess and monitor applications, agreements and claims and provide you with technical advice

Natural England and Defra will share your personal research data with each other. They may share it with the Yorkshire Dales National Park Authority so they can carry out research on the RBAPS pilot.

Natural England and Defra respect your personal privacy when responding to access to information requests. They only share information when necessary to meet the statutory requirements of the Environmental Information Regulations 2004 and the Freedom of Information Act 2000.

How long Natural England and Defra hold personal data

Natural England and Defra will hold your personal data for 7 years after the end of your agreement.

What happens if you do not provide the data

For scheme data, Natural England will not be able to provide advice on or administer your RBAPS agreement. This includes paying claims.

For research data, Natural England and Defra will not be able to learn how you feel about the pilot. This may include your:

• views on what works and what does not work
• suggestions for improvements

Use of automated decision-making for profiling

The information you provide is not used for:

• automated decision making (making a decision by automated means without any human involvement)
• profiling (automated processing of personal data to evaluate certain things about an individual)

Transfer of data outside the European Economic Area (EEA)

Natural England and Defra will not transfer your data outside of the EEA.

Your rights

Find out about your individual rights under the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

Complaints

You have the right to make a complaint to the Information Commissioner’s Office at any time.
