Notice by the Secretary of State under section 52 of the National Parks and Access to the Countryside Act 1949: Isle of Wight, lengths IOW2, IOW7 and IOW10

Introduction
On 18 March 2020 Natural England submitted a compendium of coastal access reports relating to the stretch of coast around the Isle of Wight to the Secretary of State for Environment, Food and Rural Affairs under section 51 of the National Parks and Access to the Countryside Act 1949 (“the 1949 Act”), pursuant to its duty under section 296(1) of the Marine and Coastal Access Act 2009 (“the 2009 Act”).
This determination relates to lengths WBH1-6, which covers the entire stretch.
In reaching a determination under section 52 of the 1949 Act the Secretary of State has considered:
a. Isle of Wight length reports IOW2, IOW7 and IOW10 – part of Natural England’s coastal access report compendium for the Isle of Wight submitted to the Secretary of State on 18 March 2020
b. in accordance with paragraph 16(1)(a) of the Schedule, the objections which the appointed person determined to be an admissible objection
c. in accordance with paragraph 16(1)(b) of the Schedule, Natural England’s comments on the admissible objections which it sent to the Secretary of State
d. in accordance with paragraph 16(1)(c) of the Schedule, the reports given to the Secretary of State by the appointed person in respect of the objections which the appointed person determined to be an admissible objection
e. in accordance with paragraph 16(1)(d) of the Schedule, representations made by a person within paragraph 2(2)(b) to (f) of the Schedule and the summary of other representations made, and Natural England’s comments on those representations which it sent to the Secretary of State in June 2020
f. Section 245 of the Levelling Up and Regeneration Act 2023 imposes a duty upon the Secretary of State, when exercising any function which has any effect upon land in a an Area of Outstanding Natural Beauty to seek to the further the purposes of those areas. In this case the creation of coastal access in and around these Areas of Outstanding Natural Beauty may have an effect upon them. However, in making this decision the Secretary of State has sought to further the purpose of the conservation and enhancement of these Area of Outstanding Natural Beauty by satisfying itself that no harm will come to these areas as a result of the creation of the new coastal access.
In this notice –
(a) “objection” means an objection about the coastal access report which is made under paragraph 3 of Schedule 20 of the Marine and Coastal Access Act 2009
(b) “representation” means a representation about the coastal access report which is made under paragraph 7 of Schedule 20 of the Marine and Coastal Access Act 2009
Secretary of State’s approval of coastal access proposals
The Secretary of State has determined to approve those proposals for the route and associated coastal margin as set out in length reports IOW2, IOW7 and IOW10.
In the respects specified in the objection set out at Annex A to this notice, the Secretary of State determines that the proposals set out in the coastal access report do not fail to strike a “fair balance” as a result of the matters specified in the objections. The Secretary of State therefore approves the proposals set out in the coastal access report so far as they relate to those parts of the route (and associated coastal margin) to which the objection relates.
Where proposals are approved in full, the additional conclusions and observations of the Secretary of State in relation to the representations are set out at Annex B to this notice.

Annex A: Objections which did not fail to strike a “fair balance”
Objection Reference: MCA/IOW2/O/2/IOW0197
The land in the Report to which the objection relates are route sections IOW-2-S079 to IOW-2-S091. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around privacy, potential income loss, access to the spreading room, and future rollback arrangements. These concerns can be mitigated with appropriate waymarking, signage, the option for reassessment of exclusions after the hotel’s redevelopment and other measures as suggested by Natural England. Consequently, the Secretary of State approves the proposals in relation to this route section.
Objection Reference: MCA/IOW2/O/1/IOW1245
The land in the Report to which the objection relates are route sections IOW-2-S122 to S124. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around access over Bembridge Angling Club’s land. Given the land is considered excepted under the Countryside and Rights of Way Act 2000, no mitigations have been suggested by Natural England, as no new public access rights are established and no exclusion of access is necessary. However, Natural England remains open to reassessing the situation based on future developments. Consequently, the Secretary of State approves the proposals in relation to this route section.
Objection Reference: MCA/IOW7/O/2/IOW1620
The land in the Report to which the objection relates are route sections IOW-7-S089 and IOW-7-S090. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around wildlife conservation, heritage preservation, and agri-environment scheme obligations. These concerns can be mitigated by the existing exclusions for sensitive wildlife areas, the low likelihood of public access to the fields due to natural and structural barriers, and the availability of alternative routes. Furthermore, there is no evidence of conflict with agri-environment schemes, and the protection of the Scheduled Ancient Monument is not considered to be at risk. Consequently, the Secretary of State approves the proposals in relation to this route section.

The land in the Report to which the objection relates are route sections IOW-7-S099 to S103. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around public safety, environmental and conservation concerns and disturbances to farming and livestock activities. These concerns can be mitigated with fencing installations to separate walkers and dogs from land management activities and other measures as suggested by Natural England. The proposed route alignment also avoids ecologically sensitive areas and minimises road crossings. Consequently, the Secretary of State approves the proposals in relation to this route section.

The land in the Report to which the objection relates is route section IOW-10-S070-FP. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around environmental sensitivities, disturbance to livestock, and the inclusion of farmland within the route’s designated spreading room. These concerns are mitigated by the natural barriers of the land’s gradient, including field boundaries, trees, and hedges, which limit views and access to the Medina, ensuring minimal use of the spreading room. Additionally, concerns can be further mitigated with appropriate waymarking, signage, and other measures suggested by Natural England, including the requirement for dogs to be kept on short leads near livestock. Consequently, the Secretary of State approves the proposals in relation to this route section.

The land in the Report to which the objection is route section IOW-10-S014-FP. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around disturbances to wildlife, nature conservation, and the protection of sensitive habitats. These concerns can be mitigated with appropriate signage, exclusion zones and other measures as suggested by Natural England, including collaboration with Bird Aware Solent to protect wildlife. Consequently, the Secretary of State approves the proposals in relation to this route section.

The Secretary of State notes the Ramblers’ proposal to adjust the route to follow the footpath along the coast, passing seaward of Ryde House. However, the Secretary of State supports Natural England’s position that, although this option was considered, a shoreline route was not feasible in this area between Wootton Bridge and Culver Down due to constraints such as unsafe terrain with mudflats and clay, tidal flooding risks, and challenging woodland areas unsuitable for infrastructure or those with limited mobility.

The Secretary of State notes the Ramblers’ objection to the inland route near Quarr Abbey, favouring a more coastal alignment. However, the Secretary of State supports Natural England’s assessment that Quarr Abbey’s need for seclusion is vital to its monastic activities and retreat operations. Also, the terrain of the more coastal route is unsuitable due to difficult, unstable ground and risks of tidal flooding.

Secretary of State’s conclusion and observation:
The Secretary of State notes the Ramblers’ concerns that the proposed route follows a busy and noisy main road and their suggestion for an alternative route through a tranquil nature reserve, which is supported by the local landowner. However, the Secretary of State supports Natural England’s position that the proposed route is more accessible and safer, as it avoids additional road crossings and provides better proximity to the sea with views. Furthermore, despite the landowner’s support for the Ramblers’ route, the local manager of the Royal Society for the Protection of Birds opposes any route through the nature reserve due to concerns about wildlife disturbance.

The Secretary of State notes the Ramblers’ proposal for a route that remains accessible during all tidal conditions. However, the Secretary of State acknowledges Natural England’s assessment that this would not be feasible due to the extensive new infrastructure required, such as revetments and retaining walls, which would be too costly given existing access options. Additionally, the Ramblers’ suggested alignment would intrude on excepted land and require creating new access which could negatively impact local environmental designations, such as the South Wight Maritime Special Area of Conservation.

The Secretary of State notes the Isle of Wight Council’s concerns regarding access restrictions along the beach between Fishbourne and Binstead and the need for reassessment of routes around Ryde House due to safeguarding concerns. However, the Secretary of State supports Natural England’s position that the Fishbourne area is primarily private land and that the current access restrictions are necessary for safety. The Secretary of State also acknowledges Natural England’s willingness to reassess the route around Ryde House if there are changes in land use.

The Secretary of State notes the Isle of Wight Council’s concerns regarding the inland alignment of the proposed route and their preference for a more coastal alignment through Quarr Abbey, as well as their view that the long-term access exclusions near Fishbourne are excessive. However, the Secretary of State supports Natural England’s position that inland detours are necessary to respect private landowner rights while balancing public access, and that the access exclusions at Fishbourne are needed for safety and effective land management.

The Secretary of State notes Bourne Leisure’s concerns that the optional alternative route should be identified as the roll-back route to provide clarity and their request for reinstating signage at both ends of the route to assist users and prevent trespassing. The Secretary of State notes the representation’s suggestion for a boardwalk through Priory Woods to address muddy conditions, a proposed reroute at Ferry Point to protect sensitive areas, concerns over access at Yar Quay Bridge due to new housing, and the need for rollback provisions between certain sections of the route to address erosion impacts. However, the Secretary of State supports Natural England’s position that, while improvements are planned at Priory Woods, geological and SSSI constraints may limit their scope.
