Summary

This consultation is focused on reviewing the Code of Practice around the Cabinet Office data matching exercises, such as the National Fraud Initiative (NFI).

Consultation description

Unforeseen delays since the consultation ended mean that we are now within weeks of the changes to data protection law in the UK being implemented. Therefore, we have decided to delay the publication of the Code until after 25 May 2018 when the General Data Protection Regulation and data protection bill (as enacted) will be the applicable legislation. This will enable us to update the Code to fully reflect this new legislation.

A full consultation response will be published here in due course.

The Local Audit and Accountability Act 2014 schedule 9, paragraph 7 requires the Minister for the Cabinet Office to continuously review the Code of Data Matching Practice (“The Code”) and consult stakeholders before it is altered.

The purpose of this Code is to help ensure that the Cabinet Office and its staff, auditors and all persons and bodies involved in data matching exercises comply with the law, especially data protection legislation, and to promote good practice in data matching.

The Code has been reviewed and updated, where necessary, to:

  • take account of the release of the NFI fraud prevention AppCheck tool and FraudHub technology;
  • take account of the latest Information Commissioner’s guidance on privacy notices and forthcoming changes to data protection legislation and
  • remove references to obsolete legislation and bodies.
